Maternity Leave for Students

Maternity Protection Act for Students

Since January 1, 2018, the Maternity Protection Act has also applied to students, provided that the location, time, or schedule of a educational event is mandatory or they are required to complete an internship as part of their training. Pregnant students must therefore be granted maternity protection as a matter of principle and without having to apply for it. During this period, there is a relative ban on examinations: normally, six weeks before and eight weeks after the birth, they have the right not to take examinations. They also have the right to be exempted from compulsory attendance at events, excursions, and laboratory and internship activities. Expectant and nursing mothers (during the first twelve months after giving birth) may not be employed between 10 p.m. and 6 a.m. or on Sundays and public holidays. However, students may waive these rights during the maternity leave period (even after giving birth). In this case, they must expressly declare this in writing to the Admissions Office/Examination Board. The declaration can be revoked at any time.

Hochschule Geisenheim University must carry out a risk assessment for every pregnant student (and pregnant employee) who reports their pregnancy. The assessment form is used to determine whether they are exposed to health hazards and whether protective measures need to be taken during pregnancy and breastfeeding without them suffering any disadvantages.

In order for Hochschule Geisenheim University to comply with maternity protection regulations, all students are advised to notify the Admissions Office of their pregnancy and expected date of delivery as soon as they are aware of these facts. There is no obligation to notify the university. However, if they fail to do so, they voluntarily waive the measures regulated in the Maternity Protection Act.
